Information on the processing of personal data:

Informing the data subject of the information necessary for the processing of personal data pursuant to Section 19(1) and (2) of Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain laws and pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council, the data subjects (customers of the controller) are informed of the following information necessary for the processing of personal data:

Farbiss s.r.o., as the Seller, hereby informs you that we process your personal data in the performance of our duties as the operator of the online shop www.gust.sk (hereinafter referred to as the " Seller"). In the processing of personal data by the controller, you are the data subject, i.e. the person about whom the personal data concerning him or her is processed.

 

What is personal data processing?

Processing of personal data shall mean a processing operation or set of processing operations concerning personal data or sets of personal data, in particular the obtaining, recording, organisation, structuring, storage, alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise, alignment or combination, restriction, erasure, whether or not by automated or non-automated means.

In simple terms, it involves the collection of personal data, its storage on information media, disclosure, adaptation or alteration, retrieval, use, transmission, dissemination, disclosure, storage, exchange, classification or combination, blocking and destruction. It's a lot, really, but it's only on the basis of the data you provide that we can provide you with services and products that specifically improve your life.

What personal data do we process?

We only process personal data that you provide to us in connection with your interest in our products and their purchase (e.g. in the context of registration, ordering or consent to the processing of personal data and consent to receive information about news and promotional offers, etc.), or the conclusion of a contract for the purchase of goods.

 

This is most often the data that you provide to us when you register and/or purchase goods:

 

a) Basic identification and address data:

 

These form the basis for the conclusion and performance of the contract. These include in particular:

  • Your name and surname
  • E-mail
  • Telephone contact 
  • The address where you can be contacted or the address to which the goods you have purchased will be delivered
  • Payment details (payment card number that we do not/do not store with your account (only when using paid services such as purchases on our e-shop, etc.)
  • Other data voluntarily filled in by you in the note when filling in the order

You voluntarily enter your personal data in the various forms on this site: the registration form and the contact form. Your personal data is used for the purposes further specified in this policy, and only to the extent necessary.

How long do we keep your data?

We will process your data for as long as you use our services (i.e. for the duration of the contractual relationship between us) and subsequently on the basis of your consent for a further 2 years, unless your consent to the processing of your personal data is withdrawn by you.

 

However, we would like to point out to you here that we must process those personal data which are necessary for the proper provision of the products you have ordered or for the fulfilment of all our obligations, whether these obligations arise from the contract between us or from generally applicable law, irrespective of the consent you have given us, for the period of time provided for by or in accordance with the relevant legislation, even after your consent has been withdrawn if necessary.

What are your rights relating to the processing of personal data?

Right of access to your personal data - you have the right to ask us to confirm whether we are processing personal data concerning you and, if we are processing your data, you have the right to obtain access to this personal data and detailed information on all facts related to the processing of this personal data (your right of access to personal data is regulated by Section 21 of Act No.18/2018 Coll. on the protection of personal data and on amending and supplementing certain laws and Article 15 of Regulation (EU) No 2016/679 of the European Parliament and of the Council). Upon your request, we are obliged to provide you with the personal data we process about you, and we are entitled to require you to pay a reasonable fee corresponding to the administrative costs for the repeated provision of such data;

 

The right to rectification of personal data - to correct incorrect data concerning you or to complete incomplete personal data (your right to rectification of personal data is regulated by Article 22 of Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain laws and Article 16 of Regulation (EU) No 2016/679 of the European Parliament and of the Council);

 

Right to erasure of personal data - Your right to erasure of personal data is regulated by § 23 of Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain laws and Article 17 of Regulation (EU) No 2016/679 of the European Parliament and of the Council), if:

  • the personal data is no longer necessary for the purpose for which it was collected or otherwise processed,
  • we are processing personal data unlawfully,
  • you withdraw your consent to the processing of your personal data and there is no other legal basis for the processing of your personal data,
  • you object to the processing of personal data and there are no overriding legitimate grounds for the processing of personal data or you object to the processing of personal data pursuant to Section 27(2) of Act No. 18/2018 Coll. on the protection of personal data and on amendment and supplementation of certain acts, (e) the reason for deletion is the fulfilment of an obligation pursuant to Act No. 18/2018 Coll. on the protection of personal data and on amendment and supplementation of certain acts, a special regulation or an international treaty by which the Slovak Republic is bound or,
  • the personal data were collected in connection with the offer of information society services pursuant to Section 15(1) of Act No. 18/2018 Coll. on the protection of personal data and on amendment and supplementation of certain acts.

You cannot exercise the right to erasure of your personal data if:

  • the processing of personal data is necessary for the exercise of a legal claim,
  • to exercise the right to freedom of expression or the right to information,
  • to comply with an obligation under Act No. 18/2018 Coll. 2016/679 of the European Parliament and of the Council, a special regulation or an international treaty by which the Slovak Republic is bound, or for the performance of a task carried out in the public interest or in the exercise of public authority entrusted to the person processing the personal data,
  • for reasons of public interest in the field of public health in accordance with Article 16(2)(h) to (j) of Act No 18/2018 Coll. on the protection of personal data and on amending and supplementing certain acts,
  • for archiving purposes, scientific purposes, historical research purposes or statistical purposes pursuant to Section 78(8) of Act No. 18/2018 Coll. on the protection of personal data and on amendment and supplementation of certain acts, if it is likely that your right would make it impossible or seriously impede the achievement of the purposes of such processing.

Right to restriction of personal data processing - Your right to restriction of personal data processing is regulated by Section 24 of Act No.18/2018 Coll. 2016/679 of the European Parliament and of the Council), if:

  • you object to the accuracy of the personal data during a period that allows us to verify the accuracy of the personal data,
  • the processing of the personal data is unlawful and you object to the erasure of the personal data and request instead a restriction on its use,
  • we no longer need the personal data for the purpose of processing the personal data, but you need it to assert a legal claim; or,
  • you object to the processing of personal data pursuant to Section 27(1) of Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain laws and Article 21(1) of Regulation (EU) No 2016/679 of the European Parliament and of the Council.

If the processing of personal data has been restricted, we may, in addition to the storage of personal data, only process personal data with your consent or for the purpose of exercising a legal claim, for the protection of individuals or for reasons of public interest;


the right to accuracy of personal data - your right to the portability of personal data is regulated by Article 26 of Act No. 18/2018 Coll. No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain laws and Article 20 of Regulation (EU) No. 2016/679 of the European Parliament and of the Council), in a structured, commonly used and machine-readable format, and you have the right to transfer this personal data to another controller if this is technically feasible and if the processing is carried out by automated means and is based on a legal basis within the meaning of Section 13(1)(a) or (b) of Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain acts, or Article 6(1)(a) or (b) of Regulation (EU) No 2016/679 of the European Parliament and of the Council, i.e. if we process personal data on the basis of your consent or for the performance of a contract or a contractual obligation.

 

Right to object - if you no longer wish to receive commercial communications or other information about news from us, you have the opportunity to object to the further processing of your personal data for the purpose of direct marketing. If you do so, we will no longer process your data for this purpose and we will not send you further commercial communications and newsletters.

How can I exercise my rights?

You can exercise your rights by asking questions about the processing of your personal data by sending a request directly to the controller.

The exercise of your rights in the above manner is without prejudice to your right to lodge a complaint with the competent supervisory authority. You can exercise this right in particular if you believe that we are processing your personal data unlawfully or in violation of generally binding legislation.
